o caso Gâmbia v. Mianmar na Corte Internacional de Justiça

Resumo

A partir da análise do objeto da controvérsia em Gâmbia v. Mianmar, que discute na Corte Internacional de Justiça a aplicação da Convenção para a Prevenção e Punição do Crime de Genocídio em face dos atos genocidas contra os birmaneses rohingya atribuíveis ao governo de Mianmar, este artigo sustenta a hipótese de haveria uma certa influência da filosofia Ubuntu na decisão de Gâmbia de levar o caso à justiça internacional. Os valores inerentes ao Ubuntu, como a necessidade de promover justiça, a paz e a interdependência entre os seres humanos universalmente, seriam capazes de explicar, ao menos em parte, tanto a empatia transcontinental de Gâmbia pelo povo rohingya quanto as razões pelas quais o país mobilizou recursos para levar o debate sobre o genocídio desse povo à jurisdição da Corta da Haia, ainda que o caso não afetasse diretamente os seus interesses soberanos.
