A doutrina da devida diligência e a responsabilidade dos estados no âmbito da crise causada por Covid-19

Resumo

A devida diligência constitui uma das fontes mais recentes de obrigações do Estado que devemos valorizar no contexto em que nos encontramos, que já possui vários precedentes jurisprudenciais. No presente trabalho, analisamos essa doutrina no âmbito da pandemia do COVID-19, utilizando os principais tratados internacionais dos quais a possível responsabilidade dos Estados derivaria em virtude dessa doutrina e de que maneira ela se materializaria.
