Abstract

This article seeks to investigate how the protection of the family of migrants occurs within the scope of the Inter-American and European Human Rights Systems. For that, at first, it investigates how the defense of this group occurs in the scope of each of the systems mentioned, examining the applicable normative protection and the rights enshrined in the jurisprudence of the Inter-American Court of Human Rights (Inter-American Court) and in the Court European Human Rights (ECtHR), respectively. In a later section, the similarities and differences between the two regional systems will be addressed, more specifically with regard to the parameters for family reunification, as well as the intersections with the International Law of Children and Adolescents and the principle of non-discrimination.
