International Crimes and Indigenous Peoples of Brazil

Abstract

Many non-governmental organizations in Brazil prepared and sent communications to the International Criminal Court with the aim of providing information to the Court's Prosecutor regarding acts that could eventually be classified as crimes within its jurisdiction. Given the various questions about the role, relevance and the lack of answers to these communications, this article seeks to examine the process and jurisprudence of the International Criminal Court as to offer an answer to these questions. In this sense, this article is guided by the question about the possible procedural reasons that would explain that there is still no situation before the International Criminal Court that investigates international crimes perpetrated against the indigenous populations of Brazil. To this end, the article is subdivided into three sections: the first examines some of the communications sent to the International Criminal Court in order to understand the arguments and facts mobilized; the second is dedicated to a better understanding of the role of the Office of the Prosecutor in receiving and accepting communications; and, finally, the third section analyses the possible procedural and jurisprudential issues that can explain to us the reason that, to date, the Office of the Prosecutor has still not opened a situation regarding the indigenous peoples of Brazil at the International Criminal Court.
