O regulamento geral de proteção de dados (GDPR)
uma análise do extraterritorial scope à luz da jurisdição internacional
Resumen
La aprobación del Reglamento General de Protección de Datos en 2016 por el Parlamento Europeo representa la ley más innovadora a nivel mundial en materia de Protección de Datos Personales. Además, la ley europea también se ha revelado fuertemente perturbadora en su ámbito territorial, abordando la posibilidad de aplicación fuera de sus fronteras. Por lo tanto, el presente documento tenía como objetivo analizar cómo el alcance territorial del GDPR cumple con los principios de jurisdicción internacional. Mediante la comprensión detallada del artículo 3 y sus conceptos principales, y la exposición de las normas de jurisdicción internacional vigentes en la actualidad, este documento examinó dónde se basa legalmente el GRPR.
